Nutzungsbedingungen (EULA)

Diese Bedingungen regeln die Nutzung der POPSTYLE.AI-App und der zugehörigen Dienste. Durch Installation, Registrierung oder Nutzung der App akzeptierst du diese Bedingungen vollumfänglich.

1. Lizenz

MySymp gewährt dir eine widerrufliche, nicht-exklusive, nicht übertragbare, persönliche und beschränkte Lizenz zur Nutzung der POPSTYLE.AI-App auf Geräten, die du besitzt oder kontrollierst, und ausschließlich gemäß diesen Bedingungen und den App-Store-Richtlinien.

3. Abonnement — Premium

Wichtige Abo-Klauseln

  • Laufzeit: Monatlich (1 Monat) oder Jährlich (1 Jahr), je nach gewähltem Plan.
  • Belastung: Die Zahlung wird beim Kauf-Bestätigen deinem Apple-ID- bzw. Google-Play-Konto belastet.
  • Auto-Verlängerung: Das Abo verlängert sich automatisch, es sei denn du schaltest die automatische Verlängerung mindestens 24 Stunden vor Ende der laufenden Periode ab.
  • Abbuchung der Verlängerung: Dein Konto wird innerhalb von 24 Stunden vor Ablauf des laufenden Zeitraums mit dem Erneuerungspreis belastet.
  • Verwaltung: Abos können verwaltet und die Auto-Verlängerung kann deaktiviert werden in den Account-Einstellungen deines App Stores (iOS) bzw. Google-Play-Kontos (Android) nach dem Kauf.
  • Keine Kündigung der laufenden Periode: Die Kündigung wirkt zum Ende der laufenden Abrechnungs-Periode. Eine anteilige Erstattung der laufenden Periode ist nicht möglich.
  • Kostenfreier Probemonat: Falls angeboten, beginnt das kostenpflichtige Abo automatisch nach Ablauf, sofern du nicht mindestens 24h vorher kündigst.

4. Erstattungen

Erstattungen werden von Apple bzw. Google nach deren Richtlinien abgewickelt. POPSTYLE.AI kann selbst keine Erstattung auszahlen. Anfragen:

5. Geistiges Eigentum

Die App, ihr Design, Code, Texte, KI-Modelle und Marken bleiben Eigentum von MySymp bzw. ihrer Lizenzgeber. Du behältst alle Rechte an deinen eigenen Garderoben-Fotos und Inhalten und gewährst uns lediglich die zur App-Funktionalität nötige Nutzung (Speicherung, Anzeige, KI-Verarbeitung in deinem Auftrag).

6. KI-Vorschläge — kein Stylist-Versprechen

Die KI-Outfit-Vorschläge sind algorithmische Empfehlungen und stellen keine professionelle Stilberatung dar. Wir übernehmen keine Garantie für „passende" Outfits — die Letztentscheidung trifft du.

7. Haftungsbeschränkung

Soweit gesetzlich zulässig haftet MySymp nicht für indirekte, mittelbare oder Folgeschäden, entgangenen Gewinn, Datenverlust oder Geschäftsunterbrechungen. Die Haftung für Vorsatz und grobe Fahrlässigkeit bleibt unberührt. Die Haftung für leichte Fahrlässigkeit ist auf den Abo-Preis der letzten 12 Monate beschränkt.

8. Verfügbarkeit

Wir bemühen uns um eine hohe Verfügbarkeit, garantieren aber keine ununterbrochene Funktion. Wartungsfenster werden, soweit möglich, im Voraus angekündigt.

9. Kündigung durch uns

Bei schwerwiegendem Verstoß gegen diese Bedingungen können wir dein Konto sperren oder kündigen. Du erhältst dann eine Frist zur Datensicherung.

10. Anwendbares Recht und Gerichtsstand

Diese Bedingungen unterliegen Schweizer Recht unter Ausschluss des UN-Kaufrechts. Ausschließlicher Gerichtsstand ist Zürich, soweit gesetzlich zulässig. Zwingende verbraucherschutzrechtliche Regelungen deines Wohnsitzlandes bleiben unberührt.

11. Änderungen

Wir können diese Bedingungen ändern. Wesentliche Änderungen werden in der App angekündigt; die fortgesetzte Nutzung gilt als Zustimmung.

Terms of Use (EULA)

These terms govern your use of the POPSTYLE.AI app and related services. By installing, registering or using the app you accept these terms in full.

1. License

MySymp grants you a revocable, non-exclusive, non-transferable, personal and limited license to use the POPSTYLE.AI app on devices you own or control, exclusively in accordance with these terms and the rules of the relevant app store.

3. Subscription — Premium

Important subscription terms

  • Length: Monthly (1 month) or Yearly (1 year), depending on the plan you choose.
  • Payment: Payment will be charged to your Apple ID or Google Play account upon confirmation of purchase.
  • Auto-renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Renewal charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the renewal price.
  • Management: Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings in the App Store (iOS) or Google Play account (Android) after the purchase.
  • No mid-period cancellation: Cancellation takes effect at the end of the current billing period. No prorated refund of the current period.
  • Free trial: If offered, the paid subscription begins automatically at the end of the trial unless cancelled at least 24 hours before the end of the trial period.

4. Refunds

Refunds are handled by Apple or Google according to their policies. POPSTYLE.AI cannot issue refunds directly. Requests:

5. Intellectual property

The app, its design, code, text, AI models and trademarks remain property of MySymp or its licensors. You retain all rights to your own wardrobe photos and content and grant us only the rights necessary to provide app functionality (storage, display, AI processing on your behalf).

6. AI suggestions — no stylist guarantee

The AI outfit suggestions are algorithmic recommendations and do not constitute professional styling advice. We make no guarantee that suggested combinations are "appropriate" — the final decision is always yours.

7. Limitation of liability

To the maximum extent permitted by law, MySymp is not liable for indirect, consequential or incidental damages, lost profits, data loss or business interruption. Liability for intent and gross negligence remains unaffected. Liability for ordinary negligence is limited to the subscription fees paid in the last 12 months.

8. Availability

We strive for high availability but do not guarantee uninterrupted service. Maintenance windows will be announced in advance where possible.

9. Termination by us

In case of serious breach of these terms we may suspend or terminate your account. You will be granted a reasonable period to back up your data.

10. Governing law and venue

These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive venue is Zurich, Switzerland, to the extent permitted by law. Mandatory consumer-protection rules of your country of residence remain unaffected.

11. Changes

We may amend these terms. Material changes will be announced in the app; continued use constitutes acceptance.
